How Authority Is Granted in a Probate Sale

Before a probate property is listed or sold, one of the first questions is:

What authority does the personal representative have?

In California probate, the personal representative may request authority under the Independent Administration of Estates Act, commonly referred to as IAEA.

This authority is not decided by the buyer, the real estate agent, or the family informally.

It is granted by the probate court.

The personal representative may request full authority or limited authority in the probate petition. The court then determines what level of authority will be granted based on the petition, the will, any objections, and the circumstances of the estate.

That authority is typically reflected in the court’s order and in the Letters Testamentary or Letters of Administration.

For real estate purposes, this matters because the authority granted by the court affects how the property can be sold.

It may determine whether the personal representative can proceed without court confirmation or whether the sale must return to court for approval.

This is why authority should be reviewed early in the process.

It affects timing.

It affects buyer expectations.

It affects the offer process.

And it affects whether court confirmation may be required.
